Privacy Policy my-place.ch

The protection of your privacy is important to us. We are committed to transparent handling of your data. Below, we explain which personal data is stored when you use this website and how this data is handled. We also show you how you can unsubscribe from third-party services that we use.

My Place respects your privacy

The protection of your privacy in the processing of personal data and the security of all business data is an important concern for us, which we take into account in our business processes. We process personal data collected during your visit to our online offerings confidentially and only in accordance with legal regulations.

The processing of data from visitors from Switzerland and countries outside the EU is exclusively subject to Swiss law, namely the Federal Act on Data Protection (FADP, SR 235.1) and the corresponding Ordinance to the Federal Act on Data Protection (SR 235.11). The EU General Data Protection Regulation (GDPR) does not apply unless explicitly stated in this privacy policy or if the GDPR would be mandatorily applicable to data from visitors from Switzerland and countries outside the EU due to special conditions.

For the processing of data from visitors from the EU, the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data, on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) also applies.

Purpose of the Website

The website provides general information about My Place as well as products, offers, and career opportunities.

General principles on the collection, processing, and use of personal data

Personal data are all information that relates to an identified or identifiable natural person, such as names, addresses, phone numbers, or email addresses, which are an expression of a person's identity.

We collect, process, and use personal data (including IP addresses) only if this is necessary for the fulfillment of a contract or for the implementation of pre-contractual measures or if the processing is necessary to safeguard our legitimate interests.

  • Contact details such as name, phone number, email addresses, address, date of birth
  • Communication data such as your IP address, the MAC addresses of the devices used like smartphones or computers, device and settings information
  • Data on purchase history such as purchase data including information on purchased products
  • Other personal data, such as credit card data, bank details, and data on professional career

Log files

Whenever you use the internet, certain information is automatically transmitted by your internet browser and stored by us in so-called log files.

We store the log files to identify disruptions and for security reasons (e.g., to clarify attempted attacks) for as long as necessary for these purposes and then delete or anonymize them. Log files that need to be retained for evidence purposes are excluded from deletion until the respective incident is finally clarified and may be passed on to investigative authorities in individual cases. The storage of log files serves our legitimate interests in ensuring the trouble-free and correct operation of our website.

The following information is particularly stored in the log files:

  • IP address (Internet Protocol address) of the device from which the online offering is accessed;
  • Internet address of the website from which the online offering was accessed (so-called origin or referrer URL);
  • Name of the service provider through which access to the online offering is made;
  • Name of the retrieved files or information;
  • Date and time as well as duration of the retrieval;
  • Transferred data volume;
  • Operating system and information about the internet browser used, including installed add-ons (e.g., for a password manager);
  • HTTP status code (e.g., "request successful" or "requested file not found").

User Analysis

On the website my-place.ch, analysis tools (e.g., Google Analytics) are used. The collected information about the usage of the websites is stored on the servers of the tool providers and additionally merged in Snowflake with data from the ERP and POS systems for evaluation purposes.

With the help of the analysis tools, we are able to capture and analyze data about the usage of our website by visitors. This allows us to determine when and from which region which page views were made.

Other data that is collected includes, for example, file names of accessed files, browsers used, functions utilized, or the duration of stay on the website.

My Place has a legitimate interest in the anonymized analysis of user behavior to optimize both the web offering and advertising. If prior consent was requested during your visit to our website (e.g., consent to store cookies), the processing is based on your consent, which you can revoke at any time for the future.

Detailed information about the analysis tools used can be found in our Cookie Policy.

Data Transfer

Your personal data will only be transferred to other controllers if it is necessary for contract fulfillment, we or the third party have an overriding legitimate interest in the transfer, or you have given your consent.

In addition, data may be transferred to other controllers if we are required to do so by legal provisions or enforceable administrative or judicial orders.

Service Providers

We commission external service providers with tasks such as marketing services, development operations, data hosting, shipping, and debugging. We have carefully selected these service providers and regularly monitor them, especially their careful handling and securing of the data stored with them. All service providers are obligated by us to maintain confidentiality and comply with legal requirements.

Transfer to Recipients Outside the EEA

We may also transfer personal data to recipients located outside the EEA in so-called third countries. In this case, we ensure before the transfer that the recipient either has an adequate level of data protection through appropriate contractual agreements or, if necessary, that you have given your consent to the transfer.

Data Storage Information: Storage Location & Retention Periods

Your data is primarily stored in Switzerland and Germany. Due to various service providers, data is also stored in other EU countries as well as within the USA.

We generally store your data as long as it is necessary to provide our offerings and related services, or we have a legitimate interest in further storage (e.g., we may still have a legitimate interest in postal marketing even after fulfilling a contract). After that, we delete your personal data except for data that we need to retain to fulfill legal obligations (e.g., we are required by tax and commercial retention periods to keep documents such as contracts and invoices for a certain period).

Marketing Tools

We use various tools for marketing activities. When using these tools, your browser sometimes establishes a direct connection to the servers of the respective tools. This allows the respective provider to receive the information that your browser has accessed the corresponding page of our offering. Log files similar to those described under point 5 are also transmitted to the servers of the respective providers and may be stored there. The provider or its server may be located outside Switzerland or the EU/EEA (e.g., in the USA).

The data exchange takes place via third-party cookies.

Further information on the purpose, scope, further processing, and use of the data can be found in our Cookie Policy and in the respective terms and conditions and data protection notices.

Newsletter

Your email address, which you provided during newsletter registration or when registering a customer account, will be used to send you information about our offerings. You can object to this use at any time by clicking on the unsubscribe link in the email.

Security

Our employees and the service providers we commission are obligated to maintain confidentiality and comply with the provisions of applicable data protection laws.

We take all necessary technical and organizational measures to ensure an appropriate level of protection and to safeguard your data managed by us, particularly against the risks of accidental or unlawful destruction, manipulation, loss, alteration, or unauthorized disclosure or access.

Your Rights

Please use the information in the "Contact Details" section to exercise your rights. Please ensure that we can clearly identify you.

Right to Information and Access

You have the right to obtain information from us about the processing of your data. For this, you can assert a right to access the personal data we process about you.

The data will be provided to you within 20 working days after receipt of your request.

Right to Rectification and Deletion

You can request the correction of incorrect data from us. If the legal requirements are met, you can request the completion or deletion of your data.

Please contact us in writing or by phone to request the deletion of your data. You can find the contact details under Contact on this page.

This does not apply to data required for billing and accounting purposes or subject to legal retention obligations.

The deletion of the data will be completed within 20 working days after receipt of your request.

Data Portability

If the legal requirements are met, you can request to receive the data you have provided to us in a structured, commonly used, and machine-readable format or, if technically feasible, to have the data transmitted to a third party.

Right to Object

Objection to Direct Marketing

You can also object at any time to the processing of your personal data for advertising purposes ("advertising objection"). Please note that there may be an overlap between your objection and the use of your data in the context of an ongoing campaign for organizational reasons.

Objection to Data Processing on the Basis of "Legitimate Interest"

You also have the right to object at any time to the processing of your data by us, provided that this is based on the legal basis of "legitimate interest". We will then stop processing your data unless we can demonstrate compelling legitimate grounds for further processing that outweigh your rights, in accordance with legal requirements.

Revocation of Consent

If you have given us consent to process your data, you can revoke this at any time with effect for the future. The legality of the processing of your data until the revocation remains unaffected.

Changes to the Privacy Policy

We reserve the right to adjust our security and data protection measures. In such cases, we will also adapt our privacy policy accordingly.
